Terms of Trade

General

Future Furness Limited, T/A Tasman Honda, reserves the right to withdraw or decline credit at any time.

 

Definitions

  • Customer: The individual or entity purchasing goods or services from Tasman Honda.

  • Tasman Honda: Future Furness Limited, trading as Tasman Honda.

  • Parts: Any components or materials supplied by Tasman Honda.

  • Services: Any work or labour provided by Tasman Honda.

 

Scope of Work

These terms cover all services and parts provided by Tasman Honda, unless otherwise agreed in writing. Exclusions may apply as specified in individual agreements.

 

Price

All prices are inclusive of GST unless otherwise stated. An on-site fee is charged for jobs done off workshop premises, covering costs such as fuel, road user charges, and vehicle maintenance.

 

Payment

Payment terms are stated on each invoice. Accounts must be paid in full by the due date. If not, a 2% interest charge will be added to the outstanding balance. Accounts sent for collection will incur all associated costs. Invoice queries must be raised within 10 working days from the invoice date by emailing accounts@tasmanhonda.co.nz. Labour costs include travel time and any related administration.

 

Payment Terms

  • Payment is due immediately upon receipt of the invoice unless otherwise arranged in writing.

  • For service jobs, payment terms are 14 days from the invoice date unless otherwise arranged in writing.

 

Service Authorization

  • By authorizing the work to be done, the customer agrees to the use of necessary materials.

  • The company does not assume any responsibility for units left for repairs, storage, or other purposes, or for articles left in units.

  • Units driven by our employees are at the owner’s risk.

 

Storage Fees

  • After notification of completion of work, the customer has 5 days to pick up their unit.

  • A per-day storage fee will be assessed after this period.

 

Deal Documents

  • All motorcycles, ATVs, SXS, outboard motors, and power products payments are due on delivery/collection unless otherwise agreed upon in writing.

  • Payment is due on acceptance of the deal and before the unit leaves the premises.

  • Ownership of goods on this invoice remains the property of Tasman Honda until payment of the purchase price in full. Monies due or received from any on-sale of these goods shall be held in trust for the seller pending payment of the purchase price in full.

 

Payment Methods

Acceptable payment methods include bank transfer, credit card, and other methods as agreed upon.

 

Late Payment Penalties

In addition to the 2% interest charge, any further penalties for late payments will be detailed on the invoice.

 

Retention of Title

Ownership of parts remains with Tasman Honda until full payment is received. Tasman Honda may repossess or resell parts and/or vehicles if payment is not made, recovering any deficiency plus repossession costs.

 

Liability on Claims

Claims for faulty workmanship or parts must be made within 10 working days of the work being carried out or parts supplied. Tasman Honda will enforce any manufacturer guarantees or warranties. Tasman Honda is not liable for consequential, indirect, or special damage or loss, nor for damage or loss caused by the customer’s agents or others. The customer indemnifies Tasman Honda against any claims arising from defects or non-compliance of parts. All warranties, descriptions, representations, or conditions whether implied by law, trade, custom, or otherwise and relating to fitness, merchantability, suitability of purpose, or otherwise are expressly excluded.

 

Dispute Resolution

Any disputes arising under these terms shall be resolved through mediation or arbitration, as agreed by both parties.

 

Governing Law

These terms are governed by the laws of New Zealand.

 

Amendments

Tasman Honda reserves the right to amend these terms at any time. Customers will be notified of any changes.

 

Confidentiality

Tasman Honda will keep all customer information confidential and will not disclose it to third parties without the customer’s consent, except as required by law.

 

Force Majeure

Tasman Honda is not liable for any failure to perform its obligations due to circumstances beyond its control, including but not limited to natural disasters, strikes, or other events of force majeure.

 

Refunds and Returns Policy

In line with the Consumer Guarantees Act, customers have the right to a repair, replacement, or refund for faulty goods.

 

Order Deposits and Returns

  • No returns without receipts.

  • No returns on electrical parts, decals, or opened packages.

  • Restocking fees will apply to any returns after 15 days and on all special-order parts.

  • No cash refunds after 30 days; in-store credit only.

  • All goods and services are supplied in accordance with Tasman Honda Terms & Conditions of Business.

  • A deposit is required for any parts orders exceeding $500.

  • The deposit amount will be 50% of the total order value.

  • This deposit is non-refundable and must be paid at the time of order placement.

  • The deposit covers initial costs incurred by the business, such as ordering parts, reserving time slots, or preparing for the service.

 

Privacy Policy

Tasman Honda handles personal information in accordance with the Privacy Act. This includes collecting information directly from customers, using it for business purposes, and allowing customers to correct or change their information.

 

Website Use

By using our website, customers agree to our terms and conditions, including intellectual property rights, user responsibilities, and limitations of liability for website use.

The customer authorises Tasman Honda to:

Collect information from third parties and authorise third parties to provide such information.

Hold information given by the customer or third parties for business purposes.

Use information, including sharing with third parties, to facilitate debt collection or other business-related activities.
