Tasman Honda – Terms of Trade
These Terms of Trade apply to all goods and services supplied by Tasman Honda Limited (T/A Tasman Honda), including motorcycle and ATV servicing, parts sales, outboard products, power equipment, online orders, and in‑store purchases.
By engaging with Tasman Honda, the customer agrees to the terms outlined below.

1. Definitions

Customer – The individual or entity purchasing goods or services from Tasman Honda.

Tasman Honda – Tasman Honda Limited, trading as Tasman Honda.

Parts – Any components, accessories, or materials supplied by Tasman Honda.

Services – Any work, labour, or workshop activities performed by Tasman Honda.

Unit – Any motorcycle, ATV, side‑by‑side, outboard motor, or power product owned by the customer.
2. Scope of Work
These terms cover all services, parts, sales, and related activities, unless otherwise agreed in writing.
Specific exclusions may apply where noted in individual agreements or job sheets.
3. Pricing

All prices are inclusive of GST, unless otherwise stated.

On‑site service jobs incur an additional fee to cover travel, fuel, RUCs, and vehicle maintenance.

Labour charges include travel time and necessary administration.
4. Payment Terms
4.1 Standard Payment

Payment is due immediately upon receipt of the invoice, unless otherwise arranged in writing.
4.2 Service Jobs

For workshop services, payment is due within 14 days of the invoice date (unless alternative terms are agreed in writing).
4.3 Late Payments

Overdue accounts incur a 2% interest charge per month on the outstanding balance.

Accounts referred to debt collection will accrue all associated recovery costs.

5. Deposits & Special Orders

Parts orders over $100 require a 50% non‑refundable deposit at the time of order.

Deposits cover costs such as ordering, freight, preparation, or securing workshop time.

Special‑order items cannot be cancelled once the order is placed.
6. Retention of Title

Ownership of goods remains with Tasman Honda until full payment is received.

Tasman Honda may repossess or resell goods or units if payment is not made, and may recover any deficiency plus repossession costs.

Payments received from any on‑sale of unpaid goods must be held in trust for Tasman Honda.
7. Deal Documents & Vehicle Sales

Payment for motorcycles, ATVs, SxS vehicles, outboards, and power products is due on delivery/collection, unless otherwise agreed in writing.

Units must be fully paid for before leaving the premises.
8. Workshop Terms & Storage
8.1 Service Authorisation
By authorising a job, the customer agrees to:

The use of necessary parts and materials

Reasonable workshop and diagnostic processes

Test rides undertaken by Tasman Honda staff
All units driven by Tasman Honda staff are operated at the customer’s risk.
8.2 Storage Fees

Once notified that work is complete, the customer has 5 days to collect their unit.

After this, daily storage fees will apply.
Tasman Honda is not responsible for loss or damage to items left inside units, or for units left on-site beyond reasonable time frames.
9. Warranty, Faulty Goods & Liability
9.1 Claims

Claims for faulty workmanship or parts must be made within 10 working days of service or supply.

Tasman Honda enforces all applicable manufacturer warranties.
9.2 Exclusions
Tasman Honda is not liable for:

Consequential, indirect, or special loss or damage

Damage caused by misuse, neglect, unauthorised repairs, or non‑genuine parts
-
Faults arising from customer‑supplied parts or accessories
9.3 General Liability
All implied warranties, descriptions, or conditions relating to fitness, suitability, or merchantability are excluded to the fullest extent permitted by New Zealand law.
10. Refunds & Returns Policy
In accordance with the Consumer Guarantees Act, customers are entitled to repair, replacement, or refund for faulty goods, depending on the nature of the issue.
Returns

No returns without a receipt.

No returns on electrical parts, decals, or opened packages (unless faulty).

Returns after 15 days and all special‑order parts incur restocking fees.

After 30 days, refunds are issued as in‑store credit only.
All goods and services are supplied in accordance with these Terms of Trade.
11. Privacy Policy
Tasman Honda complies with the New Zealand Privacy Act.

12. Website Use
By using the Tasman Honda website, customers agree to:

Respect intellectual property rights

Acknowledge that website availability and accuracy cannot be guaranteed
13. Information Sharing (Privacy Act Authorisation)
The customer authorises Tasman Honda to:

Collect information from third parties

Use and store information for business, service, and warranty purposes

Share information with third parties only when required to facilitate debt recovery or essential business operations
14. Force Majeure
Tasman Honda is not responsible for delays or failure to perform obligations due to events beyond our control, including natural disasters, strikes, or other unforeseen circumstances.
15. Dispute Resolution
Any disputes arising from these terms will be resolved by mediation or arbitration, as agreed by both parties.
16. Governing Law
These Terms of Trade are governed by the laws of New Zealand.
17. Amendments
Tasman Honda may update these Terms of Trade at any time.
Updates take effect immediately when posted online or communicated to customers.
